YCT Nay. Amendment 5 to SB 791 caps fees for a backup, perpetual care account for radioactive waste sites in Texas. With passage of the amendment, an individual waste generator will still be responsible for up to $500,000 of the perpetual care account. If the amount in the fund is reduced so that the waste generator’s portion is below $350,000, the fees will be increased again. An earlier amendment imposed fees on individual generators until the balance of the entire account reaches $150 million
