SB 212: Regulating Sexual Harassment Reporting
Passage; March 26, 2019; Journal Page 615; 31 Yeas.
YCT Nay. SB 212 requires employees of public and private institutions of higher education to "promptly report" sexual harassment, sexual assault, dating violence, or stalking of a student or employee of the institution to the institution's Title IX coordinator. The bill provides exceptions to the mandatory reporting component for those employees designated by their institution to be "confidential employees," as well as providing an exception in which the employee themselves was the victim of sexual harassment, sexual assault, dating violence, or stalking. YCT opposes SB 212 because it compels, under penalty of law, the employees of private institutions to report suspected instances of sexual misconduct, imposing an undue infringement upon individual autonomy in the making of a decision which, by its very nature, is extremely sensitive and personal.
